The Distributor shall be solely liable for any and all claims, if any, and keep The Supplier free and harmless from any and all claims of third parties in that respect. (i) based on defective or unsafe products in the Territory or (ii) arising out of undertaking his obligations under this Agreement as well as against all charges, costs and expenses incurred in defending, contesting or settling such claims or demands, unless the same can be shown to be attributable solely to Supplier’s acts or default.
