Article 1 – The purpose of this Law is to ensure the development of a financially sound and transparent electricity market operating in a competitive environment under provisions of civil law and the delivery of sufficient, good quality, low cost and environment-friendly electricity to consumers and to ensure the autonomous regulation and supervision of this market.

BİRİNCİ BÖLÜM

Amaç, Kapsam ve Tanımlar



Amaç

MADDE 1. — Bu Kanunun amacı, belediyenin kuruluşunu, organlarını, yönetimini, görev, yetki ve sorumlulukları ile çalışma usûl ve esaslarını düzenlemektir.

Kapsam

MADDE 2. — Bu Kanun belediyeleri kapsar.

Tanımlar

MADDE 3. — Bu Kanunun uygulanmasında;

a) Belediye: Belde sakinlerinin mahallî müşterek nitelikteki ihtiyaçlarını karşılamak üzere kurulan ve karar organı seçmenler tarafından seçilerek oluşturulan, idarî ve malî özerkliğe sahip kamu tüzel kişisini,

b) Belediyenin organları: Belediye meclisini, belediye encümenini ve belediye başkanını,

c) Belde: Belediyesi bulunan yerleşim yerini,

d) Mahalle: Belediye sınırları içinde, ihtiyaç ve öncelikleri benzer özellikler gösteren ve sakinleri arasında komşuluk ilişkisi bulunan idarî birimi

İfade eder.

İKİNCİ BÖLÜM

Belediyenin Kuruluşu ve Sınırları

Kuruluş

MADDE 4. — Nüfusu 5.000 ve üzerinde olan yerleşim birimlerinde belediye kurulabilir. İl ve ilçe merkezlerinde belediye kurulması zorunludur.

İçme ve kullanma suyu havzaları ile sit ve diğer koruma alanlarında ve meskûn sahası kurulu bir belediyenin sınırlarına 5.000 metreden daha yakın olan yerleşim yerlerinde belediye kurulamaz.

Köylerin veya muhtelif köy kısımlarının birleşerek belediye kurabilmeleri için meskûn sahalarının, merkez kabul edilecek yerleşim yerinin meskûn sahasına azami 5.000 metre mesafede bulunması ve nüfusları toplamının 5.000 ve üzerinde olması gerekir.

Bir veya birden fazla köyün köy ihtiyar meclisinin kararı veya seçmenlerinin en az yarısından bir fazlasının mahallin en büyük mülkî idare amirine yazılı başvurusu ya da valinin kendiliğinden buna gerek görmesi durumunda, valinin bildirimi üzerine, mahallî seçim kurulları, onbeş gün içinde köyde veya köy kısımlarında kayıtlı seçmenlerin oylarını alır ve sonucu bir tutanakla valiliğe bildirir.

İşlem dosyası valinin görüşüyle birlikte İçişleri Bakanlığına gönderilir. Danıştayın görüşü alınarak müşterek kararname ile o yerde belediye kurulur.

Yeni iskân nedeniyle oluşturulan ve nüfusu 5.000 ve üzerinde olan herhangi bir yerleşim yerinde, İçişleri Bakanlığının önerisi üzerine müşterek kararnameyle belediye kurulabilir.

Sınırların tespiti

MADDE 5. — Yeni kurulan bir belediyenin sınırları, kuruluşu izleyen altı ay içinde aşağıdaki şekilde tespit edilir:

a) Eskiden beri o yerleşim yerine ait sayılan tarla, bağ, bahçe, çayır, mera, otlak, yaylak, zeytinlik, palamutluk, fundalık gibi yerler ile kumsal ve plajlar belediye sınırı içine alınır.

b) Belediye sınırlarını dere, tepe, yol gibi belirli ve sabit noktalardan geçirmek esastır. Bunun mümkün olmaması durumunda, sınır düz olarak çizilir ve işaretlerle belirtilir.

c) Belediyenin sınırları içinde kalan ve eskiden beri komşu belde veya köy halkı tarafından yararlanılan yayla, çayır, mera, koru, kaynak ve mesirelik gibi yerlerden geleneksel yararlanma hakları devam eder. Bu haklar için sınır kâğıdına şerh konulur.

d) Çizilen sınırların geçtiği yerlerin bilinen adları sınır kâğıdına yazılır. Ayrıca yetkili fen elemanı tarafından düzenlenen kroki sınır tespit tutanağına eklenir.

Sınırların kesinleşmesi

MADDE 6. — Belediye sınırları, belediye meclisinin kararı ve kaymakamın görüşü üzerine valinin onayı ile kesinleşir.

Kesinleşen sınırlar, valilikçe yerinde uygulanmak suretiyle taraflara gösterilir ve durum bir tutanakla belirlenir. Kesinleşen sınır kararları ile dayanağı olan belgelerin birer örneği; belediyesine, mahallî tapu dairesine, il özel idaresine ve o yerin mülkî idare amirine gönderilir.

Kesinleşen sınırlar zorunlu nedenler olmadıkça beş yıl süre ile değiştirilemez.

Sınır uyuşmazlıklarının çözümü

MADDE 7. — Bir il dâhilindeki beldeler veya köyler arasında sınır uyuşmazlığı çıkması hâlinde ilgili belediye meclisi ve köy ihtiyar meclisi ile kaymakamın görüşleri otuz gün süre verilerek istenir. Vali, bu görüşleri değerlendirerek sınır uyuşmazlığını karara bağlar. Büyükşehir belediyesi sınırları içinde kalan ilçe ve ilk kademe belediyelerinin sınır değişikliklerinde büyükşehir belediye meclisinin de görüşü alınır.

İl ve ilçe sınırlarının değiştirilmesini gerektirecek sınır uyuşmazlıklarında 5442 sayılı İl İdaresi Kanunu hükümleri uygulanır.

Birleşme ve katılma

MADDE 8. — Belde, köy veya bunların bazı kısımlarının bir başka beldeye katılabilmesi için bu yerlerin meskûn sahalarının katılınacak beldenin meskûn sahasına uzaklığı 5.000 metreden fazla olamaz.

FIRST SECTION
Purpose, Coverage and Definitions


Purpose

Article 1- The purpose of this Law is to arrange the establishment, bodies, management, duties, powers and responsibilities and working principles and procedures of municipality.


Coverage

Article 2- This law covers municipalities.


Definitions

Article 3- In the application of this Law, the following terms shall have the following meanings:

a) Municipality: public legal person having administrative and financial autonomy, which is established to meet common requirements of town residents and whose decision-making bodies are formed through election by electors,

b) Bodies of municipality: Municipal council, municipal board and mayor,

c) Town: Place of settlement having a municipality,

d) Quarter: Administrative unit which is located within municipal borders, where people live in neighborhood relation among themselves, whose common requirements and priorities show similar characteristics.


SECOND SECTION
Establishment and Borders of Municipality Establishment


Establishment

Article 4- Municipality may be established in the settlement units with population of 5,000 and above. It is compulsory to establish a municipality in provincial and district centers.

A municipality may not be established in the drinking and service water basins and in heritage sites and in other protected areas and in the settlement places whose inhabited site is closer than 5,000 meters to the borders of an established municipality.

In order for villages or various village parts to establish a municipality by merging, their inhabited sites must be maximum 5000 meters from the inhabited site of a settlement place to be accepted as center and their total populations must be 5,000 and above.

Upon decision of the village council of elders of one or several villages or upon written application of minimum simple majority of the electors thereof to the highest territorial governor of the locality or in case the governor himself deems it necessary, local election boards shall, within 15 days upon notice of the governor, collect the votes of the electors registered in the village or in parts of the village and notify the governor’s office of the result with a record.
The processing file is sent to the Ministry of Interior together with the opinion of the governor. A municipality is established at that place with joint decree-law, by obtaining the opinion of the Council of State.

A municipality may be established with joint decree-law upon proposal of the Ministry of Interior at any place of settlement which has been formed due to new settlement and whose population is 5,000 and above.


Determination of borders

Article 5- Borders of a newly-established municipality is determined as follows within six months following its establishment.

a) Places such as agricultural field, vineyard, garden, meadow, pasture, common range, alpine pasture, olive grove, acorn yard, brushland, and sandy shore and beaches are included in municipal borders.

b) In principle, municipal borders should pass over such certain and fixed points as stream, road etc. If this is not possible, the border is drawn in a straight manner and is indicated with marks.

c) Traditional rights to enjoy high plateau, meadow, pasture, closed wood, spring water and excursion spots which remain within municipal borders and which has long been enjoyed by the residents of neighbouring towns or villages shall continue. An annotation is put on the certificate of boundary for such rights.

d) Known names of the places over which drawn borders pass are recorded on the certificate of boundary. Furthermore, the sketch issued by authorized technical officers is attached to the protocol determining the boundary.


Finalization of borders

Article 6- Municipal borders become final with approval of the governor upon a decision to that effect of the municipal council and opinion of sub-governor.

The borders that become final are shown to parties by applying the same on site by the governor’s office and the situation is recorded in a protocol. One copy each of the border decisions that have become final and of the documents on which they are based are sent to the municipality concerned, to the local land register office, to the provincial local administration and to the territorial governor of that place.

The borders that have become final may not be changed for a period of five years unless there are mandatory reasons to do so.


Settlement of border disputes

Article 7- If, there arises a border dispute among the towns or villages located within a province, opinions of the municipal council and of the village council of elders and of the sub-governor concerned is requested by granting a period of thirty days. The governor evaluates these opinions and decides upon the border dispute. Opinion of the metropolitan city council is requested as well in case of change of the borders of the district and first level municipalities remaining within the borders of metropolitan municipality.

In case of border disputes that will necessitate change of provincial and district borders, provisions of the Law numbered 5442 on Provincial Administration shall apply.


Mergers and Annexations

Article 8- In order for a town, village or some parts thereof to be annexed to another town, the distance of the inhabited sites of such places to the inhabited site of the town they will be annexed to may not be more than 5,000 meters.
