1. Rechtskultur: Geschichte, Empirie und Dogmatik
Die Antwort auf die Frage, woher das Recht kommt, hat sich als sehr weitläufig erwiesen. Weitläufig, weil – wenn auch nur beispielhaft – unerwartet viele Fährten sichtbar gemacht werden konnten und deutlich wurde, dass es weitere Ursprünge gibt, die uns die Rechtsgeschichte und die Rechtsvergleichung lehren können. Diese Disziplinen sind wichtig, um unser geltendes Rechts und dessen kulturelle Verwurzelung besser zu verstehen, insbesondere zu erkennen, dass es z.T. auf langen Erfahrungen und tiefen anthropologischen Einsichten beruht. Weiter hat sich gezeigt, daß gutes Recht auf gründlicher Kenntnis der geregelten Sachverhalte beruht und praktikabel gestaltet ist. Schließlich hat sich zu Gunsten der Rechtsgelehrsamkeit erwiesen, dass es ein Bündnis von Gesetzgebung und Rechtsdogmatik gibt, das die Rechtsordnung stabilisiert und erst im vollen Sinne darstellt. Verarbeitete Geschichte, Empirie und Dogmatik stellen die Rechtskultur dar.
2. Nochmals Recht und Staat
Nachdem wir uns über das Woher der Inhalte des Rechts eine gewisse Einsicht verschafft haben, möchte ich zum Schluß noch einmal auf die Rolle des Staates zurückkommen. Der Staat ist nicht immer der Schöpfer des Inhalts des Rechts. Die unverzichtbare Aufgabe des Staates ist es aber, das Recht in Geltung zu setzen und zu sichern.
