4 Civil legal aid
4.1 What will legal aid cover?
If advice and assistance will not solve your problem, and you need to take your case to court, you may need to apply for legal aid. Your solicitor cannot represent you in court under legal aid for some kinds of case, such as:

• small claims of less than £3,000, unless the claim involves personal injury
• some actions relating to bankruptcy.

However, they may be able to advise you on these under advice and assistance.

4.2 How do I qualify for legal aid?
You and your solicitor will fill in application forms about your case and financial situation, and send these to us. We will then assess your application.

To grant legal aid, we have to decide that:
• you qualify financially
• you have a legal basis for your case (called “probable cause”)
• it is reasonable to use public funds to support your case – for example, it may not be reasonable to grant legal aid if the person you are trying to sue has no money; your case will cost much more than it is worth; it looks unlikely that you will succeed, you are using the wrong court, or if have not fully considered other ways of sorting out the problem, before you take court action.
• help is not available to you from someone else – like a trade union, insurance company (some types of case might be covered by say, your household or car insurance policy) or professional body.

4 Příspěvek k financování nákladů soudního sporu

4.1 Jaké služby jsou hrazeny příspěvkem k financování nákladů soudního sporu?

Pokud právní poradenství a pomoc nevyřeší váš spor a je zapotřebí postoupit případ soudu, máte možnost požádat o občansko-právní pomoc při financování nákladů soudního sporu.

V některých případech není možné, aby vás advokát občansko-právní poradny zastupoval u soudu. Tyto případy jsou:

• malé pohledávky ve výši nižší než £3,000, pokud nárok nezahrnuje osobní újmu
• některé případy týkající se bankrotu.

4.2 Jak zjistím, jestli mám nárok na občansko-právní pomoc při financování nákladů soudního sporu?

Podmínky nároku na příspěvek k financování nákladů soudního sporu jsou:

• splňujete finanční podmínky
• máte právní opodstatnění případu (tzv.: „právní důvod")
• považuje se za přiměřené čerpat z obecního fondu na podporu vašeho případu, např. není možné žádat o příspěvek k financování nákladů soudního sporu v případě, že požadujete peníze od osoby, která je nemá. To by bylo plýtvání penězi poplatníků; také v případě, že předpokládaný výsledek je prohra sporu, nebo pokud jste u špatného soudu, nebo pokud jste nevyčerpal/a jiné možnosti vyřešení sporu mimosoudně.
• pokud nemáte možnost získat finanční pomoc z jiných zdrojů, jako např. z odborového svazu, od pojišťovny (některé typy sporů je možné takto hradit, např. pojištění domu nebo automobilu), nebo od jiné profesní instituce.

Bio
I am a Czech national who has lived in England for 12 years. Following completion of a Degree in English, I taught ESOL at a Private Secondary School in the UK. I also studied a Trinity College course to teach ESOL to adult learners.
I have a formal training qualification in translation, through the City University London's Diploma in Translation and in 2005 I become a Member of the Chartered Institute of Linguists. In 2009 I gained a DPSI qualification in English Law option. I currently work as a freelance translator and proofreader for a subtitling company based in the USAand I travel round the region (North East England) as an interpreter. I am keen to develop my professional skills in various areas of translation and interpreting.
I regularly visit the Czech Republic to keep in contact with family and friends as well as cultural and political development of the country.
Based from home, I have all necessary hardware, software and web connectivity to ensure that I can deliver services effectively to any organisation worldwide. Prices are based on a per-word rate, following the ITI's guidelines and are negotiable (in the region of Ł65/100words or $15/100words depending on circumstaces).
My recent work includes a DVD version of a catalogue for Moravian Gallery to accompany an exhibition about Art Restoraion, website for a Czech sculptor exhibiting in NY or work-related questionaires for a large international company as well as medical translations for patient use.
