Sul suo tronco abitano merli e scoiattoli, la sua base è coperta di edera e disseminata di violette. Le sue favolose radici affondano nella pancia dell´Irpinia per dieci metri almeno, in un prato coperto di fiori blu e papaveri. La pelle è quella rugosa e rinsecchita di un vecchio Navajo; il busto s´attorciglia a un palo di castagno e forma una scultura di ottanta centimetri di circonferenza. Poi, a due metri e mezzo di quota, il coriaceo gomitolo si dipana, diventa quattro braccia nodose che si piegano a novanta gradi, come capestri, e partono verso l´orizzonte disegnando una grande rosa dei venti. Quattro branche aggrappate a fili di ferro, da cui pendono piccole protuberanze legnose appena potate e pronte dar frutto. Per le trecentesima volta dopo trecento anni.
Ne ha di vita in corpo il patriarca di Taurasi, la vite in servizio attivo forse più vecchia del pianeta, nata prima di Napoleone e della scoperta dell´Australia. Con alcuni "cugini" più piccoli della stessa zona, è anche l´ultimo rappresentante mondiale di una tribù antichissima, dal nome misterioso che viene da Oriente: sìrica. Il capolinea di tremila anni di cultura, genetica, gusto e migrazioni nella geografia eurasiatica fino al grande approdo chiamato Italia. Un "rosso" mitologico della Magna Grecia, arrivato sulla costa jonica da chissà quando e da chissà dove, forse dalle terre di Noè attraverso la Dalmazia, portato in Italia da chissà quali mercanti - parrebbe su navi elleniche degli iblei o degli intraprendenti focesi - e poi risalito fino alla terre fertili della Campania.
Lo assedia un frastuono di cinciallegre e calabroni, un brulicare di vita scomparso nel Nord dei pesticidi, e tu ti chiedi dove stia il mistero di tanta forza. Il grande vecchio di Taurasi è sopravvissuto a tutto. Alla rivoluzione del clima, all´abbandono delle campagne e al dilagare della boscaglia. Alla fillossera che un secolo fa ha annientato i vitigni europei. Alla barbarie delle potature industriali che ha amputato e ucciso le piante più adulte. Alla tirannia degli enologi che ha prodotto vini perfetti e senz´anima. Testardo, ha tenuto duro contro tutto. La dittatura della genetica, che ha umiliato la geografia e il territorio; le monocolture che hanno portato un patrimonio autoctono inestimabile a un passo dall´estinzione; le infezioni epidemiche partite dai vivai industriali. Soprattutto contro il dilagare dei chardonnay e dei cabernet, che ha evirato la biodiversità italiana e cacciato le "stirpi" più rare in riserve indiane dimenticate.
Irpinia, colline senza fine, fili di fumo che segnano qua e là i roghi dei giunchi della potatura. Abbaiare di cani, pale eoliche a distanza, sorgenti; il sole affoga nella bruma verso il Vesuvio e le prime luci si accendono sui villaggi di crinale. È qui che trovi il vecchio brigante e i suoi fratelli, nascosti tra le smagliature del terremoto, in un terreno poroso dove il piede affonda senza sporcarsi, mimetizzati tra viti di agliànico contorte come ulivi, protetti da querce, cachi, peri, ciliegi, salici, noci, mandorli, fichi e noccioli, in un piccolo podere sulla cima di un colle, sopra l´antica via Appia-Traiana. Qui, non in mezzo ai vitigni-reggimenti, alle file infinite di piante-reclute schierate su terre nude e senza fiori, carne da cannone da sacrificare in fretta sul campo del mercato.
L´hanno trovato quasi per caso, qualche anno fa. C´era un´équipe che stava mappando le vigne dimenticate d´Italia. La guidava il trentino Attilio Scienza, professore di viticoltura all´università di Milano, per conto della casa vinicola "Feudi di San Gregorio". La zona prometteva bene: terre fertili, cariche di vigoria, e una minuziosa topografia di vitigni autoctoni dai nomi arcani: fiano, agliànico, sciascinoso, mantonico, piedirosso, serpico e falanghina. Stavano lì, a marcare il territorio, a raccontare storie antiche come la biblioteca di Alessandria. Ma quando arrivarono al podere del signor Sabatino Di Jorio, gli esploratori capirono presto di aver di fronte qualcosa di inestimabile. Una vigna secolare, con in mezzo tre piante ancora più secolari. Roba mai vista prima.
I vecchi mormorarono un nome, sìrica, e subito iniziarono scoperte mirabolanti. Si vendemmiò, e dai bicchieri emerse a sorpresa un gusto morbido, dolce, che si credeva estinto. Si esplorò il dna della pianta; si videro le affinità con l´agliànico, il lagrein e il teròldego; si appurò la presenza di componenti antiossidanti - e quindi anti-tumorali - sette volte più forti che in qualsiasi altro rosso. Si tagliarono dei tralci e si riprodusse la pianta attraverso barbatelle nuove da cui sono nati da poco i figli del grande vecchio. Solo alla fine ci si accorse di avere acchiappato per la coda un testimone del tempo, destinato alla cancellazione e all´oblio. Era come avere ritrovato gli ulivi del Getsèmani.
Ma non era solo la biologia; era la storia e la geografia che si svelavano. La vite parlava come un libro aperto. Diceva di essere arrivata da un porto della Jonio chiamato Siri e di avere preso da quello il suo nome. Svelava tracce indelebili del suo passaggio sulla via Appia-Traiana, la marcava come una pietra miliare dopo un itinerario serpentiforme alto sulla valle del Busento, Potenza e la Lucania profonda. Raccontava favolosi itinerari centro-asiatici e illirici. Illuminava angoli sconosciuti della Magna Grecia. Diceva che la struttura a spalliera della vite era quella "a tennecchie" che i Sanniti avevano imparato dagli Etruschi di Capua, e diceva pure che quello sposalizio culturale fra uva greca e tecniche italiote poteva essere la spia di un innesto fra la pianta venuta da Oriente e viti selvatiche ritenute sacre in terra etrusca.
La sìrica diceva soprattutto quello che la modernità omologante tendeva a dimenticare, e cioè che l´Italia, piantata in mezzo al Mediterraneo, era stata un favoloso laboratorio di contaminazione e di sopravvivenza delle specie. Racconta Attilio Scienza: “In zone antiche e promiscue, ai margini delle mode, si era salvato un arcipelago di biodiversità che non aveva eguali nel mondo”, un patrimonio vitale che andava mappato in fretta e salvato dalla distruzione come gli animali dell´Arca dal diluvio. Centinaia di vitigni rari dimenticati in terre meno "nobili" come la Calabria interna, l´Etna, la Sardegna remota, il Molise o il Mantovano. Lontano dalle Langhe o dalle terre di Montalcino. Un po´ come il sagrantino di Montefalco, che stava letteralmente scomparendo e oggi, dopo un salvataggio acrobatico, ha raggiunto i vertici della qualità.
Ma il patriarca irpino svelava anche il segreto della sua vecchiezza. Perché la sìrica aveva tenuto duro lassù mentre due chilometri in là altre piante erano state spazzate via dagli acàridi della fillossera? Lentamente, i conti tornavano. Dipendeva da quel terreno soffice, paludoso e vulcanico, dalla grana delle sabbie, abrasiva e ostica per gli insetti sterminatori. Si vide che un po´ tutta la Campania, grazie ai vulcani, aveva resistito alla pestilenza più a lungo di altre regioni e fra le due guerre aveva esportato uva in mezza Europa, dove le vigne erano in ginocchio. Anni di fertilità irripetibile, da cento quintali all´ettaro, cui seguì, nel dopoguerra, la quasi scomparsa della regione dal mercato del doc. Un´eclissi che oggi si rivela un vantaggio e consente di affrontare la modernità senza avere liquidato la manualità contadina.
“È quasi soltanto a Sud - raccontano Pierpaolo Sirch e Marco Simonit, esperti friulani che apprezzano le terre tra Ofanto e Volturno - che la tecnica di potatura è rimasta corretta”. Lo vedi anche dagli alberi sulle strade, o dai frutteti: nessuno, qui, si sogna di amputare rami più vecchi di due anni, quelli che faticano a cicatrizzare e spesso restano con le ferite aperte alle intemperie, ai funghi e ai parassiti. L´Italia, fa notare Marco Simonit, è una terra di vigne inestimabili dove l´operazione fondamentale - la potatura - è spesso affidata a personale avventizio e incompetente. “Si tranciano rami vecchi con la motosega, si lavora solo per far produrre, anche se questo va a scapito della longevità del vigneto. Il risultato è che la Francia, la Spagna o la Grecia lavorano, in media, su vigne molto più vecchie di quanto non faccia l´Italia, che pure è il Paese col patrimonio storico più straordinario del mondo. Da noi viti più vecchie di quarant´anni sono una rarità. Tutti, specie nel Centro-Nord, pensano ai concimi, al passaggio dei trattori, alla corretta palificazione, ai fili di sostegno, all´imbottigliamento. Il superfluo trionfa. Pochi pensano all´essenziale, costruire una longevità. Il bello è che sono convinti di saper potare e non accettano lezioni. Se poi chiedi come mai le loro viti crepano così giovani, alzano le spalle, danno la colpa al clima o ai fertilizzanti…”.
Ecco, la sìrica è anche questo: un monumento alla buona manutenzione, il frutto della cura di generazioni, una dedizione fatta di tempo, pazienza, attese, minuzia. Una sapienza mediterranea che ha lasciato testimonianze uniche. A Pantelleria, dove la coltivazione ad alberello ha preservato un patrimonio genetico che nessuna vigna clonata potrà mai costruire. In Francia, dove si fanno le feste della potatura per tramandare la sapienza dei vecchi, e dove nelle etichette si avverte il bevitore non solo dell´invecchiamento in bottiglia, ma anche della vecchiezza della pianta. O nel Priorato, sopra Barcellona, dove vigne centenarie crescono in campo aperto, rugose e contorte come le anime dannate nelle stampe di Gustavo Doré sulla Commedia dell´Alighieri.
Antonio Minichiello, della "Feudi di San Gregorio", mi accompagna in mezzo a piante venerabili, davanti alle quali sarebbe giusto far prostrare politici, scolaresche, manager, finanzieri d´assalto, tutti a chiedere scusa di cinquant´anni di sprechi e sviluppo cannibalico. Guardi la sìrica e capisci: gli alberi da frutto che la circondano hanno vaccinato il terreno, fornito una formidabile difesa contro le pestilenze da monocoltura, protetto i vitigni dalle contaminazioni globali. E poiché le piante da frutto, per millenni, non sono mai state solo cibo ma anche rito e comunione col sacro, ponte tra cielo e terra madre, ecco che la testarda longevità dei patriarchi irpini nasce anche dall´antico rispetto per la vecchiaia, vista come serbatoio di memoria vitale.
È una superstizione che la moderna biologia conferma: nelle piante secolari si nasconde davvero la banca-dati della vita, un´esperienza in adattamento ambientale, un codice d´accesso alla salvezza genetica che in tempi di disastro climatico diventa indispensabile all´umanità. “È proprio in questa vecchiezza la forza dei vitigni italiani, non nel giovanilismo sconsiderato che dilaga”, s´accalora il professor Scienza. “È su questo che siamo unici al mondo, è su questo che diventiamo imbattibili rispetto ai vini sudafricani, cileni o californiani, prodotti di piantagioni recenti”.
Non vi è nulla di simile in Europa. Certo, in Alto Adige, in Slovenia o in Ungheria hai singoli esemplari anche più vecchi, ma sono viti protette, conservate in chiostri o nei cortili delle case, monumenti "in vitro", isolati dalle vigne. Qui hai esemplari in campo aperto, un terra promessa inesplorata che si svela. Antonio Minichiello la sente come un rabdomante, è certo che se si potessero esplorare tutti i poderi verrebbero fuori altre sorprese. “Ho trovato un piedirosso ad albero, enorme… Si espandeva in orizzontale fino a formare un ombrello di centocinquanta metri di circonferenza, non bastavano i pali a tenerlo su. Ora lo hanno accorciato… non abbiamo ancora potuto valutarne l´età”. Si commuove, Antonio, per questa sua terra grassa e mai stanca, serpeggiante di fontanili, dove tutto ha sapore, dalle melanzane alle conserve fatte in casa.
Tramonta, l´ultima luce viola accarezza piante di broccoli, patate, aglio, finocchio e piselli, cresciute spontaneamente tra le vigne della leggenda. Ce n´è di strada da fare per scoprire il mistero italico di queste terre fertili e ondulate, inquiete, sismiche, punteggiate di luci fin sulle cime dei monti, le terre di Pitagora e Zenone, mitologico approdo dei Greci e fantastico laboratorio di contaminazione fra popoli italici, longobardi, etruschi, arabi, slavi, albanesi, normanni. Culture, sapienze manuali inestimabili che è possibile leggere sui rami di ogni albero. “Non mi importano i master post-laurea - brontola Simonit - qui c´è da ricostruire in fretta una manualità perduta per salvare un patrimonio. Persino la Turchia e la Georgia hanno scuole di potatura. L´Italia no… dobbiamo arrivarci in fretta. A che serve il biodinamico se manca il buon senso?”.
Ermete Realacci, presidente di Symbola, fondazione per le qualità italiane, è convinto di essere alla vigilia di una seconda rivoluzione dell´enologia, dopo quella salutare esplosa al termine dello scandalo-metanolo. È la rivoluzione che riporta in luce l´anima delle viti. “Il futuro del vino non sta nella perfezione - si infiamma Sirch - ma nel suo contrario! La perfezione fa emergere l´enologo. L´imperfezione svela l´anima del territorio, mette in moto la memoria, accende la fantasia, svela il genius loci. È come un amico, che lo ami quasi più per i suoi difetti che per le sue virtù”. L´antropologo Lévy Strauss nel suo memorabile Il cotto e il crudo, ricorda che ciò che è buono “da mangiare” è pure buono “da pensare”: cioè ti alimenta culturalmente. Bere nutre anche l´anima.
Basta dunque con lo schioccare di palati saccenti, con le bottiglie blasonate in défilée come altezzose modelle. “L´eccesso di tecnica ha annacquato l´identità, mistificato i vini, imbalsamato il gusto, impoverito la memoria del palato”, protesta Attilio Scienza. La bontà di un vino non discende da un´autopsia o da una graduatoria a punti, ma da un insieme. Da una personalità, fatta anche di piccoli difetti. Se bere riesce a comunicare tutto questo, allora eccoci vicini all´anima della pianta, dunque al segreto della vita. È così che il vino assolve fino in fondo il suo compito. Ti riporta a Dio, come ai tempi di Noè.

Noah’s Vineyard

It has produced grapes for three hundred years and its roots reach down ten meters into the fertile hills of Irpinia, but the origins of this patriarch—uncovered through the study of its DNA—go back some three thousand years to the Eastern lands described in the Bible
Squirrels and blackbirds live among its branches, its base covered in ivy and sprinkled with violets. The extraordinary roots reach down into the belly of Irpinia for ten meters at least, under a meadow covered in red poppies and blue wildflowers. Its skin is as a wrinkled and dry as an old Navajo chief. The trunk wraps around a chestnut pole to form a sculpture that measures eighty centimetres around. At about two and a half meters up the leathery ball unravels to form four knotty arms that bend to form right angles like a halter, spreading out to the horizon, drawing the shape of a wind compass against the sky. Little woody protuberances hang from the four branches clutching the wire, bulges that have just been pruned and are ready to give fruit. For the three hundredeth time in three hundred years.
The patriarch Taurasi has life in its body yet. It is possibly the oldest active grapevine on the planet, born before Napoleon, before the discovery of Australia. Along with some of its smaller “cousins” from the same area, it is the last living example of an ancient tribe, called by a mysterious Oriental name: Sìrica. The end of the line of three thousand years of culture, genetics, taste and migration across the Eurasian continent to reach the great shores of Italy. A mythological “red” from Magna Graecia, which arrived on the Ionic coast who knows when from who knows where, perhaps from the land of Noah, across Dalmatia, brought to Italy by unknown merchants—maybe on board Hellenistic ships by the ancient peoples of Ibla or the enterprising Phoceans-- to wind up in the fertile land of Campania.
Assaulted by the noisy din of birds and bumblebees, seething with a life unknown in the North of pesticides, you wonder what is the secret of this strength. The great and ancient Taurasi has survived everything. Climactic revolutions, the desertion of the countryside, the spread of scrubby underbrush. It survived phylloxera, the pest that wiped out European grapevines one hundred years ago. It survived industrial pruning that amputated and killed older vines, survived the tyranny of the oenologists who produced perfect, soulless wines. Stubborn, it stood its ground against everything. Against the dictatorship of genetics, which humiliated geography and terroir; the monocultures that brought priceless native stocks to the brink of extinction; the epidemic infections introduced through industrial nurseries. And most of all against the flood of Chardonnays and Cabernets that castrated Italian biodiversity and exiled the rarer “races” to forgotten Indian reserves.
Irpinia is a land of endless hills, wisps of smoke that signal bonfires here and there, burning deadwood after a pruning. The barking of dogs, steep Aeolian mountain slopes in the distance, trickling springs, the sun drowning in the haze around Vesuvius, first lights coming on in the villages perched on the ridges. It is here that you find the old brigand and his brothers, hidden among the gaps created by the earthquake, in a porous soil where the foot sinks in without getting dirty, camouflaged among the Aglianico grapevines, twisted like olive trees, protected by oaks, persimmons, pears, cherries, willows, walnuts, almonds, figs and hazelnuts, on a tiny hilltop farm above the ancient Appian way. Here. Not in the middle of regimented vineyards, infinite fields of planted recruits lined up on naked soil, cannon fodder readily sacrificed on the battlefield of the marketplace.
It was discovered by a small team of oenologists mapping out Italy’s forgotten native grapevines
They found it almost by chance, a couple of years ago. A small team led by Attilio Scienza, professor of grape-growing at the University of Milan, was mapping out Italy’s forgotten vineyards on behalf of the wine producer “Feudi di San Gregorio”. The area was promising: fertile soil, full of vigour, and a meticulous topography of obscure native grapevines: fiano, aglianico, sciascinoso, mantonico, piedirosso, serpico e falangina. There they were, marking out the land, telling their ancient tales like the library of Alexandria. But upon arriving at the farm of Mr. Sabatino Di Jorio, the explorers realized right away that they had come across something priceless. A centuries-old vineyard, containing three grapevines that were even older still. Who had ever seen such a thing?
Its name is Sìrica, it produces a smooth, sweet red; a survivor once believed extinct
The old men mumbled a name, Sìrica, and immediately the wondrous discoveries began. Grapes were harvested and made into a wine with a smooth, sweet taste believed to have long been extinct. The DNA of the plant was evaluated, affinities with aglianico, lagrein and terodelgo were found, along with a concentration of antioxidants (which reduce the risk of cancer) seven times greater than any other red. Cuttings from the vine produced new vine shoots, and the children of the great old vine were born. It wasn’t until later that it was realized how narrowly this witness from ancient history had escaped its destiny of becoming extinct and forgotten forever. It was like finding the legendary olive trees of Getsèmani.
But in wasn’t just biology talking; it was history and geography revealed. The grapevine was an open book, and this is what it said: it came from a port on the Ionian sea called Siri, from which it took its name. It revealed the indelible traces of its passage, marking it out like milestones along a serpentine route high above the Bussento valley to Potenza and deep into the hinterlands of Lucania. A tale of fabled central-asian and illyrian itineraries. It shone in unknown corners of Magna Graecia. The characteristic shape of the vines like a headboard was what the Samnites learned from the Etruscans of Capua. It was a product of the marriage between a Greek vine and Italic techniques, or just maybe the evidence of the grafting of Oriental plants to the wild grapevines sacred to the Etruscans.
But sìrica’s message was one that modern homogeneity tends to forget: that Italy, right in the middle of the Mediterranean, was an incredible laboratory for the diffusion and survival of different species. Attilio Scienza explains: “What we have, in the preservation of these ancient areas of intermingling, far from the fashions of the day, is an archipelago of biodiversity unlike any other.” A living heritage to be mapped out in a hurry and rescued from destruction, like the animals on the arc were rescued from the flood. Hundreds of rare and forgotten grapevines in lands themselves forgotten: the Calabrian interior, Etna, the remote reaches of Sardinia, Molise, the Mantovano. Far from the hills of Piedmont or the area around Montalcino. One virtuoso rescue is Sagrantino of Montefalco, saved from disappearing altogether, and which today has reached the height of quality.
Many rare vines, pushed out of the market by more fashionable grape varieties, are being rediscovered and put into production again
The Irpinian patriarch also revealed the secret of its longevity. Why has Sìrica survived up here while just two kilometres away other vines were completely wiped out by the phylloxera? The answer wasn’t immediately apparent, but was to be found in that soft, boggy, volcanic soil, its grains of sand abrasive and unwelcome for the killer insects. It can be seen in places all over Campania. It is thanks to the volcanoes that this land could resist the pestilence much longer than other regions; in the period between the first and second World Wars, when vineyards were severely crippled, grapes from Campania were exported all over Europe. Those were years of unbeatable fertility, one hundred quintals per hectare, and then, in the aftermath of World War II, the almost complete disappearance of the region from the market of DOCs (Denominazione di Origine Controllata). An eclipse that today seems an advantage, a way to meet the future without having destroyed the traditional know-how used on these small farms.
“Usually it is only in the South—say Pierpaolo Sirch and Marco Simonit, experts from the northern region of Friuli who have a special appreciation of the lands located between the Southern rivers Ofanto and Volturno—that pruning is still done correctly.” It can be seen even from the trees lining the streets, or from the orchards: nobody here would dream of cutting off branches older than two years, those are the ones that have difficulty healing, and often are left with wounds open to the elements, to fungi and parasites. “Italy is a land of priceless vineyards where the operation fundamental to their maintenance, pruning and trimming, is often left to transient, incompetent personnel,” notes Marco Simonit. “They shear off old branches with chainsaws, they work only to produce, even if in the end this compromises the longevity of the vineyard. As a result, France, Spain and Greece work, on average, with vineyards much older than those used in Italy, which after all is the country with the most extraordinary historical heritage in the world. Where we are from, grapevines older than forty years are a rarity. Everyone, especially in the area of the centre-north, thinks about fertilizers, tractors, the right way to set up the poles, about support wires and bottling. It’s the triumph of the superfluous. Hardly anyone thinks about what is essential, about enabling longevity. And of course they are convinced that they know the right way to prune and will not accept lessons. If you ask them how come their grapevines perished so young, they shrug their shoulders, blame the weather, the fertilizers…”
Yes, the Sìrica is also this: a monument to good maintenance, the fruit of generations of care, of patience and waiting and devotion to details. A Mediterranean knowledge that has left unique testimonials. On the island of Pantelleria, the cultivation in the shape of a small tree has preserved a genetic heritage that no cloned grapevine could ever reproduce. In France there are festivals celebrating pruning to pass down traditional wisdom, and wine labels list not just the aging in the bottle, but the age of the grapevine as well. In Priorato, north of Barcelona, centuries-old grapevines grow in open fields, wrinkled and twisted like the souls of the damned in the Gustavo Dorè’s famous print from Dante’s Divine Comedy.
Antonio Minichiello from “Feudi di San Gregorio” shows me around these venerable vines, in front of which politicians, school children, aggressive financiers should be feel humbled, should ask for forgiveness for fifty years of waste and cannibalistic development. Looking at the Sìrica you understand: the fruit trees that surround it have immunized the soil, have provided a formidable defence against the pestilences of monocultures, protected these grapevines from global contamination. And for thousands of years these same fruit trees have not just been a source of food but a rite and communion with the sacred, a bridge between the sky and mother earth. The stubborn longevity of these Irpinian patriarchs arises from an ancient respect for age, seen as a reservoir of vital memory.

There is nothing like it in all of Europe. In sentence 6.5.2002 the Turin Court of Appeals rejected the primary appeal brought forth by ... Srl against ...opposing the sentence of the court of law of the aforementioned city, and granted the heading of the original lawsuit.
Observing the primary appeal regarding the demotion of the employee, Mrs. ... was adjudicated to have performed the duties of executive in the administrative sector and to have possessed extensive authority to represent the company up until January 1998, when she was replaced by a certain ..., and subsequently prescribed and performed lesser duties limited to the editing of procedures for the ISO certification, and for all intents and purposes demoted on the hierarchical scale to performing an underclass of clerical duties. On the order of the quantification of professional damage, it was observed that the requested reduction of the equitable quantification of damages from 70 to 50% of the remuneration was unfounded in regard to the particular gravity of the “stripping of responsibility”, the position of leadership that was previously held, as well as the vituperative character of the “demotion”.
It is likewise unfounded the instance that censured the application of the periodic incremental adjustments of seniority in the determination of salary difference in the last 5 years, because having statutory prior credits, her right to greater seniority should have been considered equivalent to those statutory credits. The Court retains that seniority is a fact and not a right, and as such is not subject to limitation. On the order of the request for damages for pain and suffering, the Court agrees with the conclusions presented by the consultant, who ascertained that the psychological suffering experienced by Mrs. ... from 1998 to 2000 was a direct consequence of the “demotion” and refuted the instance that cited a coincidental connection.
On the order of the heading of the original lawsuit, the charge related to the subtraction of the remuneration in the quality of “executive” and the superminimo [supplementary component of salary exceeding a minimum set by the national contract] paid out in the position of “clerk” revealing the correlation to a different title without right to the superminimo was found unproven. On the other hand, other items should not have been subtracted in compensation, as Mrs. ... is under no obligation to demonstrate that these corresponded to the indications in her pay-slip, in fact she sustains that items regarding the reimbursement for expenses and travel time amounting to the sum of € 8336,90 cannot be subtracted and claims payment of this sum from her employer. It was deemed unwarranted, however, the claim for the calculation of the t.f.r. [accumulated severance pay regulated by national contract] on the statutory remuneration, citing that the allowance account [a prevision of the national contract] as described by article 2120 of the c.c. [civil code] is applied to the owed sum, and therefore does not apply to the statutory sum.
... proposes to appeal to the Cassation on four instances, Mrs. ... files a counterclaim and proposes to appeal the original claim for two instances, for which Bresciani files a counterclaim. The parties have presented their claims.
MOTIVATIONS FOR THE DECISION
Appeals opposing the same sentence are to be joined together in adherence to article 335 c.p.c.. [Civil Procedural Code]
In the first part, ... charges violation and false application of article 2103 of the c.c in relation to article 41 of the constitution, citing defect of motivation (article 360 nn.3 and 5 c.p.c.) and contesting the “demotion” of Mrs. ..., setting forward that there had not been an evaluation of the new responsibilities of the employee to determine if these duties were of a lesser class, and that Suppo was entrusted with a much broader array of responsibilities than those held by Mrs. ..., and that the power to hire new employees constitutes an aspect of the right to free enterprise guaranteed by the constitution.
This censure is unwarranted. The justification for the “demotion” is not subject to censure either on logical or juridical grounds. On the order of the former duties the Territorial Court retains its judgement on the verification of the status of “executive” with complete access to the administrative sector of the business. In regards to the subsequent duties, the Court finds that Mrs. ... was assigned limited responsibilities, neither executive nor managerial, which were carried out under the instruction of Suppo, her replacement in the executive administration of the company. The “demotion”, as the privation of executive responsibility, and as ascertained by the presiding judges, appears incontestable. The “stripping of workplace responsibilities” cannot be justified as freedom of enterprise guaranteed by article 41 of the constitution, insofar as it is limited by article 2103 of the c.c. safeguarding workers rights at an equivalent constitutional level.
In the second part, the charge of violation and false application of articles 1226 and 1203 of the c.c., defect of motivation and the iniquity of a statutory severance settlement, the claimant protests that the challenged sentence has not specified the reasons for which the demotion could be considered of particular gravity, and therefore objects to the absolute iniquity of the severance pay in contrast to the well-established case-law which has awarded the maximum of 50% of remuneration for the damages of “stripping of workplace responsibility” and recalls the precedent sentence of the Cassation # 3341 of 1996 invoking a severance pay no higher than 50%.
This censure is unwarranted.
The claimant does not specify what makes up the pretence of violation of articles 1226 and 1203, and framing of the part is to be retained generic and therefore inadmissible.
The defect of the omitted motivation for equitable severance pay is invalid, because the challenged sentence, as specified in the passage on page 16 of the appeal, sets forward the gravity of the “stripping of responsibility” based on the subject’s seniority, the position of leadership that was previously held, and the vituperative character of the “demotion”. The sustainability of the reasons for the severance settlement is not contested on logical or juridical grounds.
The iniquity of an equitable assessment does not constitute grounds for appeal to cassation, as per article 360 c.p.c. The precedents invoked to lend legitimacy do not establish general criteria for an equitable assessment but are restricted to limiting the logical and judicial criteria used, a category which is not specifically contested.
Lastly, the sentence cited, as is clear from a reading of the given passage, limits itself to stating that an employee cannot receive an additional sum (apart from the reparations) equal to the remuneration of the period of “lesser responsibility”. On logical and juridical grounds, the damages of “stripping of workplace responsibility”, “consisting of the pejorative compromising of the c.d. individual faculty of competition in respect to others in a social and economic relationship.”, c.f.r. Cass. #13266 of 1992, there is only one parameter of assessment for the compensation due the employee. However, in theory, this compensation could exceed the remuneration of the referred period, as in the present case, in which the lack of recognition for the rank of executive with the responsibilities of administrative director performed for many years was followed by the assignment of non-managerial clerical duties, a fact which has affected the employee’s curriculum, consequently making it difficult for her to be hired as an executive by another company.
In the 3rd part, the accusation of violation and false application of articles 2077 and 2099 of the c.c., and the defect of motivation as well as the iniquity of the reckoning of remunerative differences, the claimant protests that the Territorial Court has not taken into consideration that Mrs. ... received remuneration higher than her contractual salary.
This censure, irrespective of the singularity of an outline for the iniquity of a reckoning, is inadmissible, because the contested sentence, detracting from the minimum salary of an executive the entire remuneration received, including the superminimi, has taken account of this eventuality, and therefore faults the requirement of defeat on this point.
In the 3rd instance, accusing violation and false application of law and defect of motivation, the claimant censures subsistence of the right to damages for pain and suffering, premises and considerations on the nature of “mobbing”, the presence of which it denies in the present case, and protests the severance settlement amount in addition to the other amounts paid out to the employee.
This censure is unwarranted, in that while the contested sentence has not ascertained the subsistence of an intentional persecution defined as “mobbing”, it has found a “stripping of workplace responsibility”, carried out in way that the 1st judge defined as “brutal”, and based on the assessments of the CTU [court-certified consulting psychologist], has linked the temporary mental disturbances experienced by Mrs. ... to this illegitimate behaviour.
The evidence that the claimant has been paid sums for different titles does not exclude that she can be compensated for these damages, deriving from an illegal contractual action on the part of the employer, nor does it affect the measure of the compensation, which moreover has not been specifically contested.
Upon examination of the original lawsuit, in one instance the claimant censures the contested sentence for having been denied the right to accumulated severance pay calculated on an executive salary, during the period that statutory salary differences were retained.
This instance is warranted. The Court retains: “The right to t.f.r. [severance pay] arises from the termination of the contractual relationship, and only from this date can the terms of limitation accrue, while the allowance account in relation to the statutory right to remuneration concurs to determine the amount of said account, as remunerations are given as a base for calculating the severance pay, and not as components of a related right.” Cass. #11470 of 1997.
The contested sentence is therefore remanded for the conceded instance, and the case is referred for further examination to the judge indicated in the decision of the judicial act. This same judge is entrusted to oversee the settlement of expenses for the judgement of legitimacy.
